How is CBD federally legal?

Since the 2018 Farm Bill only limits the amount of Delta-9 THC and does not account for THC-A, this flower can be sold as hemp even though it becomes intoxicating when used.

Understanding Delta-8, Delta-10, and HHC

Alongside THC-A flower, there are other hemp-based intoxicants that have grown in popularity, including Delta-8, Delta-10, and HHC. These compounds are often chemically converted from CBD and infused into gummies, vapes, and other products. Like THC-A flower, they fall under the hemp category because they meet the 0.3 percent Delta-9 THC limit. However, they can still cause a high and are often sold without regulation, testing, or age restrictions. This lack of oversight means consumers cannot always be sure of the purity or safety of what they are buying.
